City of Wilson Election Charter Ordinance

A CHARTER ORDINANCE AMENDING CHARTER
ORDINANCE NO. 1-85 RELATING TO THE ELECTION AND APPOINTMENT OF CITY OFFICERS AND TERMS
OF OFFICERS AND TRANSITIONING THE TERMS
OF OFFICE FOR THE GOVERNING BODY

WHEREAS, the Kansas Legislature passed L. 2015, ch.88, sec. 7 (H.B. 2104) which provides in part that all general elections for members of the governing body and other elected officials of any municipality shall be held in November and this conflicts with Wilson City Charter Ordinance No 1-85, so that the City's Charter Ordinance on the month of elections and providing for transitional terms for those offices should be established.
THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WILSON, KANSAS:
Section 1. General elections for members of the governing body shall be held on the Tuesday succeeding the first Monday in November, 2016, and succeeding elections for governing body positions shall be held each year on such date thereafter for such governing body positions whose terms are expiring.
Section 2. Those governing body positions with terms that would have expired in April, 2016 shall expire on the second Monday in January of 2017, when the City officials elected in the November 2016 general election take office. Those governing body positions with terms that would have expired in April 2017 shall expire on the second Monday in January of 2018, when the City officials elected in the November 2017 general election take office.
Section 3. The governing body shall consist of a mayor and five (5) council members. There shall be elected in November of each odd-numbered year a mayor and two (2) council members and on each even-numbered year three (3) council members. The council members shall be chosen by the qualified electors residing with the city limits of Wilson, Kansas, and no person shall be eligible to the office of council member who is not at the time of his election or appointment an actual resident of the City of Wilson, Kansas, and, if any council member shall move outside of the city limits of Wilson, Kansas, his office as council member shall thereby become vacated.
Section 4. This Charter Ordinance shall be published once each week for two consecutive weeks in the official city newspaper.
Section 5. This Charter Ordinance shall take effect 61 days after the final publication unless a sufficient petition for referendum is filed, requiring a referendum to be held on the ordinance as provided by Article 12, Section 5, Subsection (c) (3) of the Constitution of the State of Kansas, in which case this Charter Ordinance shall become effective upon approval by the majority of the electors voting thereon.
Passed by the Governing Body, by not less than two-thirds of the members elect voting in favor thereof, this 4th day of January, 2016.
