City of Ellsworth vacating alley in Block 26 in Blake's Addition

ORDINANCE NO. 3069

BEING AN ORDINANCE VACATING THE ALLEY
BETWEEN LOTS THREE, FOUR, FIVE AND SIX
IN BLOCK 26, BLAKE’S ADDITION TO THE CITY
OF ELLSWORTH, KANSAS.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF ELLSWORTH, KANSAS
That pursuant to K.S.A. 13-443 the City of Ellsworth has the power to vacate an alley within the city boundaries whenever the city council deems the same necessary.
Furthermore, it is necessary and in the best interest of the City to officially vacate the alley between Lots 3 and 4 and Lots 5 and 6 in Block 26, Blake’s Addition to the City of Ellsworth, Kansas, and therefore the City orders the same be vacated in its entirety.
Furthermore, the City acknowledges with the passing of this ordinance that said alley revert to the abutting property owners adjacent to each side thereof in proportion to the frontage of said real estate.
 A copy of this ordinance duly certified shall be filed in the Office of the County Clerk and Office of the Register of Deeds and the same shall be effective upon said filing and publication once in the Ellsworth Independent Reporter.
