City of Wilson Election Charter Ordinance Revision

CHARTER ORDINANCE NO. 03-2016

A CHARTER ORDINANCE AMENDING SECTION 3 OF CHARTER ORDINANCE NO. 02-2016 RELATING TO THE ELECTION AND APPOINTMENT OF CITY OFFICERS AND TERMS OF OFFICERS AND TRANSITIONING THE TERMS OF OFFICE FOR THE GOVERNING BODY

WHEREAS, Wilson City Charter Ordinance No. 02-2016 does not expressly state whether the City’s election will be partisan or non-partisan.
THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF WILSON, KANSAS:
Section 1. Section 3 of Charter Ordinance 02-2016 shall be amended as follows:
    Section 3. The governing body shall consist
    of a mayor and five (5) council members. There
    shall be elected in November of each
    odd-numbered year a mayor and two (2)
    council members and on each even-numbered
    year three (3) council members. The council
    members shall be chosen by the qualified
    electors residing with the city limits of Wilson,
    Kansas, and no person shall be eligible to the
    office of council member who is not at the time
    of his election or appointment an actual resident
    of the City of Wilson, Kansas, and, if any
    council member shall move outside of the city
    limits of Wilson, Kansas, his office as council
    member shall thereby become vacated.  
    The elections shall be non-partisan.
Section 2. All sections not in conflict with this Charter Ordinance shall remain in full force and effect.
Section 3. This Charter Ordinance shall be published once each week for two consecutive weeks in the official city newspaper.
Section 4. This Charter Ordinance shall take effect 61 days after the final publication unless a sufficient petition for referendum is filed, requiring a referendum to be held on the ordinance as provided by Article 12, Section 5, Subsection (c) (3) of the Constitution of the State of Kansas, in which case this Charter Ordinance shall become effective upon approval by the majority of the electors voting thereon.
Passed by the Governing Body, by not less than two-thirds of the members elect voting in favor thereof, this 18th day of April, 2016.
