Ellsworth County Resolution to create the position of Ellsworth County Counselor

RESOLUTION 2016-R-09

(A Resolution Creating The Position
of Ellsworth County Counselor)

NOW UPON THIS 10th day of October, 2016, the Board of County Commissioners of Ellsworth County, Kansas, (hereinafter “Board”) is met in regular session with a quorum present, and
WHEREAS the Board is cognizant that there will be a vacancy in the position of Ellsworth County Attorney in January of 2017, and
WHEREAS the Board is firmly convinced that the county counselor’s duties currently exercised by Ellsworth County Attorney Joe Shepack, an attorney with thirty-three (33) plus years experience, should not devolve upon an unnamed successor county attorney with less experience, and
WHEREAS a majority of Kansas counties employ an appointed County Counselor, in addition to an elected County Attorney, and
WHEREAS K.S.A. 19-247, et. seq. specifically allows the Board to create the position of County Counselor,
NOW, THEREFORE, BE IT RESOLVED that the position of Ellsworth County Counselor is herewith created effective January 1, 2017.
FURTHER, BE IT SO RESOLVED that this will be a contractual position, with the contract extending one (1) calendar year, with a new contract to be entered into in December of 2017. A compensation package will be negotiated, with the funding to be drawn from the existing, 2017, Ellsworth County Attorney budget.
