NOTICE OF HEARING

THE STATE OF KANSAS TO ALL PERSONS CONCERNED:
You are hereby notified that a Petition for Determination of Descent has been filed in this Court by James L. Belden, heir of Chery L. Anderson, deceased, requesting:
    Descent be determined of the following described real estate situated in Ellsworth County, Kansas:
An undivided one-sixth (1/6) interest in and to the South Half of the Northeast Quarter (S½ NE¼) of Section Twenty-one (21), and the Southeast Quarter (SE¼) of Section Twenty-one (21), Township Sixteen (16) South, Range Six (6) West of the 6th P.M., in Ellsworth County, Kansas;
    EXCEPT the following described tracts:
A parcel of land situated within Section 21, Township 16 South, Range 6 West of the 6th P.M., more particularly described as follows:
Beginning at a point on the South line and 1651.3 feet Westerly of the Southeast corner of aforesaid Section 21;
thence Westwardly on said South line 1069.4 feet to the West line of E½ said Section 21;
thence Northwardly on said West line to the North line of S½NE¼;
thence Eastwardly on said North line, 1040.8 feet;
thence Southwardly parallel to the East line of aforesaid Section 21, 3957.4 feet to the point of beginning, containing 95.79 acres, more or less.
ALSO EXCEPT: A tract of land in the Southeast Quarter of Section 21, Township 16 South, Range 6 West of 6th P.M., described as follows:
Beginning at the Southeast corner of said Section 21,
thence West along the South Section line of said Section for a distance of 1651.3 feet to a point;
thence Northerly, parallel to the East line of said Section for a distance of 520.0 feet to a point;
thence Easterly parallel to the South line of said Section for a distance of 1651.3 feet to a point on the East line of said Section;
thence Southerly along the East line of said Section for a distance of 520.0 feet, to the Southeast corner of Said Section, the point of beginning, containing 19.7 acres, more or less, (subject to roads and highways).

ALSO EXCEPT: A tract of land in the Southeast Quarter of Section 21, Township 16 South, Range 6 West of the 6th P.M., described as follows:
Beginning at a point which is located as follows: 1651.3 feet West along the South line and 520 feet North and parallel to the East line from the Southeast corner of Section 21, Township 16 South, Range 6 West; from said point of beginning,
thence North and parallel to the East line 700 feet to a point;
thence East and parallel to the South line for a distance of 250 feet to a point;
thence South and parallel to the East line for a distance of 700 feet to a point which is on the North line of Smoky Hill Village Unit #1;
thence West along this North line of Smoky Hill Village Unit #1 a distance of 250 feet to the point of beginning, above tract contains 4.02 acres, more or less;
and
An undivided one-sixth (1/6) interest in and to the South Half (S½) of Section Twenty-two (22), Township Sixteen (16) South, Range Six (6) West of the 6th P.M., in Ellsworth County, Kansas,

EXCEPT a parcel of land described as follows:
Beginning at the Southwest corner of aforesaid Section 22;
thence Northwardly on the West line of said Section 22, 1500 feet;
thence Eastwardly parallel to the South line of said Section 22, 400 feet;
thence Southwardly parallel to the aforesaid West line 1500 feet to aforesaid South line;
thence Westwardly on said South line 400 feet to the place of beginning.

and all personal property and other Kansas real estate owned by the decedent at the time of death.  And that such property and all personal property and other Kansas real estate owned by the decedent at the time of death be assigned pursuant to the laws of intestate succession.
You are required to file your written defenses thereto on or before June 22, 2017, at 11:00 a.m. at the Ellsworth County Courthouse, in the City of Ellsworth, Ellsworth County, Kansas, at which time and place the cause will be heard.  Should you fail therein, judgment and decree will be entered in due course upon the Petition.
