Vacate road in Wilson Township

BEFORE THE BOARD OF COUNTY COMMISSIONERS OF ELLSWORTH COUNTY, KANSAS
IN THE MATTER OF THE PROPOSED VACATION
OF A ROAD IN WILSON TOWNSHIP
CERTIFICATE OF OPINION AND ORDER
FOR ROAD CLOSURE
NOW UPON THIS 30th day of May, 2017, the Board of County Commissioners of Ellsworth County, Kansas, is met in regular session with a quorum present for the purpose of acting as road viewer with respect to the request of the Wilson Township Board for vacation of a certain township road, pursuant to K.S.A. 68-102a, et. seq.
THEREUPON the Board finds that the road at issue is described as follows:
The road in question is 4th Road running north
and south as between the SE ¼ of Section 9
and the SW ¼ of Section 10 in Township 14
South and Range 10 West of the 6th P.M.,
with the portion of the road to be vacated
being that portion of the road commencing
780 feet north from Avenue C and ending
at the south boundary of Interstate 70.
THEREUPON the County Commissioners find that notice has been served by the County Clerk upon all those persons who own land, or lease land adjoining the road in question, and, also, that notice of this hearing has been published in the official county newspaper as required by K.S.A. 68-102a.
THEREUPON the Board finds that it is in the public interest that the above-described road be vacated, such that it is no longer a public road, and such that the neighboring land owners would take title the real estate comprising this road, subject to any claim of easement, whether express or prescriptive, that may be successfully advanced by a private third party. The Board makes no decision as to compensation for private third parties who may be affected by this road closure.
THEREUPON THE BOARD, HAVING FULFILLED IT'S DUTIES AS ROAD VIEWERS, HEREIN CONSIDERS, ORDERS, RESOLVES AND DECREES THAT THE FINDINGS ABOVE MADE BE AND THEY ARE HEREBY MADE AN ORDER, JUDGMENT, DECREE, AND/OR RESOLUTION OF THIS BOARD.
BE IT SO ORDERED AND RESOLVED.
