Resolution No. 17-R-15

A RESOLUTION ESTABLISHING A RECREATION
DISTRICT WITHIN CERTAIN AREAS
OF ELLSWORTH COUNTY

WHEREAS, the legislature of the State of Kansas has established recreation districts based upon township boundaries and school boundaries, but has not specifically prohibited recreation districts from being established on other boundaries, and
WHEREAS, the Board of County Commissioners of Ellsworth County, Kansas finds that such township and school boundaries do not reflect the community interests in certain parts of Ellsworth County, Kansas concerning an appropriate recreation district.
NOW, THEREFORE, BE IT RESOLVED, ORDERED AND ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF ELLSWORTH COUNTY, KANSAS:
SECTION 1. That a Marquette Recreation District shall be and is hereby established with the following powers and duties covering certain areas in Ellsworth County, Kansas.
SECTION 2. That the recreation district before mentioned shall hereafter be known as the Marquette Recreation District and the boundaries of Marquette Recreation District, and shall encompass the tracts of real estate described in Exhibit ‘A’ to this resolution.
SECTION 3. That such Marquette Recreation District shall be operated by a Marquette Recreation District Board, hereinafter referred to by the Board, created by the Board of County Commissioners of Ellsworth County, Kansas from individuals living within said Marquette Recreation District.
SECTION 4. That the said Board of the County Commissioners is authorized to conduct the activities of the district on any property under its custody and management or with proper consent on any other public property and upon private property with the consent of the owners and may receive gifts from any source whatsoever.
SECTION 5. That the Marquette Recreation District Board shall consist of three members to be appointed by the Board of County Commissioners of Ellsworth County, Kansas, the first appointee to serve for two years, the second and third appointees to serve for one year after which the second and third appointee on the odd years, the first appointee for a term of two years to be appointed on the even years. Whenever a vacancy shall occur in the membership of said Board, the Board of County Commissioners shall fill such vacancy for the unexpired term of the member he or she is succeeding. Said Board shall elect a presiding officer and secretary.  Said Board is hereby empowered to operate a system of public recreation and play grounds, acquire equipment, and maintain land, buildings or other recreation facilities, employ persons for recreation programs administered by the Board, expend funds for that purpose, and accept gifts and donations and bequests for the operation of programs by the district. In addition, but no by way of limitations to all other powers necessary for the Board to carry out its appointed functions as set forth in this resolution. The amount received from tax herein provided shall be set over to said Board and used by said Board for the purposes herein set out and shall be held by the Treasurer of Ellsworth County, Kansas who shall be the ex officio treasurer of said Board. All financial records of said Board shall be audited as provided in K.S.A. 75-1122 and a copy of such annual audit report shall be filed with the Board of County Commissioners of Ellsworth County, Kansas.
SECTION 6. That the Board shall annually and not later than twenty days prior to the date of the publishing of the Ellsworth County Budget, certify its budget to the Board of County Commissioners of Ellsworth County, Kansas, which shall authorize the County Clerk to levy a tax sufficient to raise the amount required by such budget.
SECTION 7. That in accordance with K.S.A. 19-117, this resolution shall be published for two consecutive weeks, and if no petition signed by 5% or more of the landowners within the proposed Marquette Recreation District has been filed within 60 days following the last publication of this resolution, the resolution shall go into effect.
