City of Ellsworth Ordinance to grant an exception to the Uniform Public Offense Code to allow for bow/arrow and Bb gun operation in limited situations in the city.

ORDINANCE NO. 3083

AN ORDINANCE GRANTING AN EXECEPTION TO THE CURRENT UNIFORM PUBLIC OFFENSE CODE SECTION 10.6 TO ALLOW FOR BOW AND ARROW AND Bb GUN OPERATION IN VERY LIMITED SITUATIONS IN THE CITY OF ELLSWORTH, KANSAS.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF ELLSWORTH, KANSAS:
SECTION 1. A land use request has been made by the Midway Extension District 4-H Shooting Sports Organization to allow them limited use of City owned land for the purpose of bow and arrow and BB gun practices and competitions.
SECTION 2. The Uniform Public Offense Code Section 10.6 currently prohibits this operation. Due to the high level of supervision and the secluded nature of the location, the governing body deems it acceptable to allow the operation of bow and arrow and BB guns in the City of Ellsworth under the following circumstances:
a. The area of usage is limited to Lots 53, 54, 55 and 56 in the Boggs’s Riverside Addition to the City of Ellsworth;
b. A representative from the Midway Extension District 4-H Shooting Sports Organization shall be present during all operation and the usage shall be heavily supervised by responsible adults. The Midway Extension District 4-H Shooting Sports Organization shall formulate specific rules and regulations to ensure safety of the participants as well as the citizens of the City of Ellsworth;
c. All equipment to be used for practices and competitions shall be removed after each usage;
d. The Midway Extension District shall provide a facility waiver form yearly;
e. The Midway Extension District shall provide proof of liability insurance.
SECTION 3. This ordinance shall take effect and be in full force from and after its passage by the Governing Body of the City of Ellsworth and publication in the official city newspaper.
