Ellsworth Ordinance Designating State of Kansas Highway 156 at E. Eighth Street as Main Trafficway

ORDINANCE NO. 3088

AN ORDINANCE DESIGNATING A CERTAIN STREET WITHIN THE CITY OF ELLSWORTH, KANSAS,
AS A MAIN TRAFFICWAY.

WHEREAS, K.S.A. 12 685 et seq. (the "Act") provides that the governing body of any city is authorized and empowered to designate and establish, by ordinance, as a main trafficway, any existing or proposed street, boulevard, avenue or part thereof, within such city, the primary function of which is, or shall be, the movement of through traffic between areas of concentrated activity within the city or between such areas within the city and traffic facilities outside the city performing the function of a major trafficway; and such designation by the governing body shall be final and conclusive; and
WHEREAS, the governing body of the City of Ellsworth, Kansas (the "City"), hereby finds and determines that a certain street, boulevard or avenue within the City should be designated and established as a main trafficway as provided by and under the authority of the Act.
THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF ELLSWORTH, KANSAS:
SECTION 1. Designation. It is hereby authorized, ordered and directed, under the authority of the Act, that the street, boulevard or avenue set forth is hereby designated and established as a main trafficway:

SECTION 2.  Effective Date.  This Ordinance shall take effect and be of force from and after its passage by the governing body of the City, approval by the Mayor and publication in the official City newspaper.
PASSED by the governing body of the City on August 13, 2018 and APPROVED AND SIGNED by the Mayor.
