NOTICE OF HEARING

THE STATE OF KANSAS TO ALL PERSONS CONCERNED:
You are notified that a Petition has been filed in this Court by Clarissa D. Whitmer and Jessica M. Hayes, daughters of Carol J. Whitmer, deceased, requesting:
Descent be determined of the following described real estate situated in Ellsworth County, Kansas:
    A tract of land in Lot 1, Block 1, Purma Addition
    to the City of Wilson, Ellsworth, County
    Kansas more particularly described as:
    Commencing at the Southwest Corner of said
    Block 1, thence along the west line of said block,
    on a bearing of N0˚36’01”W a distance of 256.09
    to a ½” iron bar, the point of beginning; thence
    continue on said west line a distance of 71.70
    feet to a existing iron bar at the platted
    Highway 40 right of way; thence along the
    Highway right of way on a bearing of S78˚51’05”E
    a distance of 80.00 feet to the west line of a
    platted utility easement, to a ½” iron bar,
    thence along the west line of said utility
    easement, on a bearing of S12˚37’15”W a
    distance of 71.07 feet to a ½” iron bar; thence
    on a bearing of N78˚05’20”W a distance of
    63.58 feet to the place of beginning. Said tract
    contains 5067 square feet more or less.
and all personal property and other Kansas real estate owned by decedent at the time of death.  And that such property and all personal property and other Kansas real estate owned by the decedent at the time of death be assigned pursuant to the laws of intestate succession.
You are required to file your written defenses to the Petition on or before February 7, 2019 at 10:00 A.M. in the District Court, in Ellsworth County, Kansas, at which time and place the cause will be heard.  Should you fail to file your written defenses, judgment and decree will be entered in due course upon the Petition.
