City of Ellsworth Cereal Malt Beverage Summary Ordinance

ORDINANCE NO. 3093 SUMMARY

On March 11, 2019 the City of Ellsworth, Kansas passed Ordinance No. 3093 entitled:

AN ORDINANCE REGULATING THE SALE OF CEREAL MALT BEVERAGE AND BEER CONTAINING NOT MORE THAN 6% ALCOHOL BY VOLUME WITHIN THE CITY
OF ELLSWORTH, KANSAS AND REPEALING CITY CODE ARTICLE 5.12.

This Ordinance repeals and replaces City of Ellsworth City Code, Article 5.12 regarding Cereal Malt Beverage retailer and wholesaler or distributor regulations and related definitions. Specifically, this Ordinance amends the City Code to allow the sale of Enhanced Cereal Malt Beverages containing not more than 6% alcohol by volume by Cereal Malt Beverage Licensees. In addition, this ordinance adds an inspection of the premises by the Chief of Police or his/her designee and other requirements to License Application Procedures. Article 5.12 is otherwise updated with minor changes. Any current CMB License holder or Applicant for CMB license is suggested to review the Ordinance in full.
This ordinance shall become effective April 1, 2019.
